Welcome to Authentique Lux.

These Terms of Service (“Terms”) govern your access to and use of the Authentique Lux website, products, services, programs, communications, and related offerings provided by Authentique Lux LLC (“Authentique Lux,” “we,” “us,” or “our”).

These Terms apply to visitors, purchasers, collectors, consignors, sellers, authentication clients, auction participants, members, and other persons who access or use our services.

By accessing our website, creating an account, purchasing merchandise, submitting merchandise, enrolling in a program, requesting a service, or otherwise engaging with Authentique Lux, you agree to these Terms and any additional terms applicable to the particular transaction or service.

If you do not agree to these Terms, please do not use the applicable services.

1. ABOUT AUTHENTIQUE LUX

Authentique Lux is an independent luxury house specializing in authenticated pre-owned and consigned luxury merchandise, including designer handbags and accessories, fine jewelry, timepieces, fashion, collectibles, estate treasures, and other exceptional property.

Our services may include:

Luxury retail
Private sales
Consignment
Direct purchase / Sell to Us
Auctions
Authentication services
Private sourcing
Concierge services
Reserve programs
Membership or client programs
Other luxury services offered from time to time

Specific services may be subject to separate agreements, eligibility requirements, policies, or transaction-specific terms.

2. ELIGIBILITY

You must be at least 18 years old and possess the legal capacity to enter into a binding agreement to purchase, sell, consign, bid upon, or otherwise transact through Authentique Lux.

By using our services, you represent that information you provide is accurate, current, and complete.

Authentique Lux may refuse, restrict, suspend, or terminate service where reasonably necessary for security, fraud prevention, legal compliance, violation of our policies, or protection of Authentique Lux, our clients, or third parties.

3. ACCOUNTS & CLIENT INFORMATION

Certain services may require an account or additional client information.

You are responsible for maintaining the confidentiality of your account credentials and for promptly notifying us of suspected unauthorized access.

We may request additional information to verify identity, payment authority, ownership, shipping information, transaction legitimacy, or eligibility for particular services.

High-value transactions may be subject to enhanced identity verification, payment verification, proof of funds, wire-transfer requirements, or other reasonable fraud-prevention measures.

4. AUTHENTICITY

Authenticity is fundamental to Authentique Lux.

Merchandise offered by Authentique Lux is subject to our applicable inspection and authentication procedures before being represented for sale as authentic.

Authentication may include examination by internal specialists, independent experts, technological resources, comparative analysis, brand-specific research, third-party authentication services, or other methods we consider appropriate.

Authentication constitutes a professional determination based upon the information, methods, reference materials, and technology reasonably available at the time of evaluation.

Specific authentication services may be subject to additional terms.

5. INDEPENDENCE FROM LUXURY BRANDS

Authentique Lux is an independent luxury resale and auction business.

Unless expressly stated otherwise, Authentique Lux is not affiliated with, authorized by, endorsed by, sponsored by, or otherwise officially associated with the designers, manufacturers, or luxury brands whose merchandise may appear on our website or through our services.

All third-party trademarks, product names, logos, and brand names remain the property of their respective owners and are used for identification and descriptive purposes.

6. PRODUCT DESCRIPTIONS & CONDITION

Many items offered by Authentique Lux are pre-owned, vintage, estate-owned, consigned, collectible, discontinued, or one-of-a-kind.

We endeavor to provide accurate descriptions, photographs, measurements, condition information, and other material information reasonably available to us.

Because pre-owned and vintage merchandise may exhibit age, wear, patina, repairs, alterations, manufacturing variations, or other characteristics, purchasers should carefully review the complete listing before purchasing.

Condition descriptions represent our professional assessment and are not representations that an item is new or flawless unless expressly stated.

Photographs form an important part of the item’s description.

Colors and appearance may vary depending upon lighting, photography, display settings, and device characteristics.

7. PRICING & AVAILABILITY

Prices are displayed in the applicable currency and may change without notice before a purchase is completed.

We reserve the right to correct typographical, pricing, inventory, technical, or descriptive errors.

Placement of an item in a shopping cart does not reserve the item.

Because many pieces are unique and may be simultaneously offered through multiple authorized sales channels, availability is not guaranteed until the transaction has been accepted and confirmed.

If an item becomes unavailable after an order is submitted but before completion, we may cancel the transaction and refund any amount actually collected for that unavailable item.

8. ORDERS & ACCEPTANCE

Submitting an order does not necessarily constitute final acceptance by Authentique Lux.

We may review transactions for:

Payment authorization
Identity verification
Fraud risk
Inventory availability
Pricing or listing errors
Shipping eligibility
Legal or regulatory concerns

Authentique Lux reserves the right to decline or cancel a transaction before fulfillment when reasonably necessary.

If we cancel a transaction after collecting payment, we will return the applicable amount as required, subject to any lawful offsets or circumstances applicable to the transaction.

9. PAYMENT & FRAUD PREVENTION

Purchasers agree to provide valid and authorized payment information.

Payments may be processed by independent payment providers.

Depending upon transaction value, risk profile, destination, or other circumstances, Authentique Lux may require:

Bank wire
Identity verification
Billing verification
Signature confirmation
Additional documentation
Alternative approved payment arrangements

We may delay shipment or release of merchandise until payment has been finally received and cleared.

Any suspected unauthorized, fraudulent, manipulated, or abusive transaction may be canceled or referred for further review.

10. FINAL SALE POLICY

Because of the unique, collectible, pre-owned, vintage, estate-owned, consigned, and often one-of-a-kind nature of our merchandise, all sales are final except where otherwise expressly stated or required by applicable law.

Purchasers are responsible for reviewing the complete listing, photographs, measurements, condition information, included accessories, and other relevant details before completing a purchase.

Questions should be directed to our Concierge Team before purchase.

Our separate Final Sale Policy is incorporated into these Terms by reference.

The former “three-strike” return system is discontinued and does not form part of these Terms.

11. SHIPPING & DELIVERY

Shipping methods, costs, estimated delivery periods, insurance availability, signature requirements, and other delivery information may vary depending upon the merchandise, destination, transaction value, and carrier.

Risk associated with carrier transportation is governed by our applicable Shipping Guidelines, carrier terms, insurance coverage, and applicable law.

Delivery estimates are estimates only and are not guaranteed unless expressly stated.

International purchasers are responsible for applicable customs duties, VAT, import taxes, brokerage charges, or other destination-country assessments unless expressly stated otherwise.

Our separate Shipping Guidelines are incorporated into these Terms by reference.

12. CONSIGNMENT

Merchandise submitted for consignment is governed by the applicable Authentique Lux Consignment & Sales Agreement in addition to these Terms.

The Consignment & Sales Agreement governs matters including:

Ownership
Authentication
Pricing
Reserves
Commission
Client proceeds
Auction authority
Withdrawal
Unsold merchandise
Third-party platforms
Chargebacks and failed transactions
Marketing rights
Payment to consignors

If these Terms conflict with a transaction-specific Consignment & Sales Agreement, the transaction-specific agreement will control with respect to that consignment.

13. DIRECT PURCHASE — SELL TO US

Authentique Lux may offer to purchase qualifying merchandise directly from a client.

Any direct-purchase offer remains subject to the stated offer terms and, where applicable, final inspection, authentication, verification of ownership, condition confirmation, and fraud-prevention review.

Once a direct-purchase transaction is completed and the seller receives the agreed consideration, ownership transfers to Authentique Lux and the transaction is final except where otherwise required by applicable law.

14. AUCTIONS

Certain merchandise may be offered through auctions conducted by Authentique Lux or through independent auction platforms.

Auction transactions may be subject to separate:

Conditions of Sale
Bidder requirements
Buyer premiums
Payment deadlines
Reserve provisions
Shipping requirements
Identity-verification requirements
Platform rules

By registering, bidding, or purchasing through an auction, the participant agrees to the applicable auction terms in addition to these Terms.

Where an auction platform maintains separate bidder or buyer terms, those terms may also apply to transactions conducted through that platform.

15. AUTHENTICATION SERVICES

Authentication services are professional evaluations based upon the characteristics of the submitted item and the methods and information reasonably available at the time of examination.

An authentication determination does not constitute an appraisal, valuation, guarantee of future resale value, investment recommendation, or representation concerning future acceptance by an unrelated third party unless expressly stated.

Authentication certificates, reports, photographs, and related materials may be subject to additional service-specific terms.

16. AUTHENTIQUE LUX RESERVE PROGRAM

Eligible merchandise may be offered through the Authentique Lux Reserve Program.

Reserve purchases are subject to the particular terms presented and accepted at enrollment, including applicable deposit amounts, payment schedules, reservation periods, default provisions, and merchandise-release requirements.

A reserved item may be removed from public availability during the applicable reservation period.

Deposits may be non-refundable where clearly disclosed and permitted by applicable law.

Reserve Program participation is subject to Authentique Lux approval and merchandise eligibility.

17. MEMBERSHIPS & PRIVATE PROGRAMS

Authentique Lux may offer memberships, private-access programs, preferred-client benefits, invitations, advance access, or other client privileges.

Program availability, benefits, eligibility, pricing, and duration may change prospectively.

Unless expressly stated otherwise, membership does not guarantee merchandise availability, auction success, allocation of a particular item, investment performance, or access to every Authentique Lux service.

Additional program-specific terms may apply.

18. GIFT CARDS & CREDITS

Gift cards, store credits, promotional credits, or similar instruments are subject to the terms disclosed at issuance and applicable law.

They may not be redeemable for cash except where required by law.

Fraudulent, altered, unlawfully obtained, or unauthorized gift cards or credits may be rejected.

19. INTELLECTUAL PROPERTY

The Authentique Lux website and original materials created by Authentique Lux—including photographs, videos, catalog descriptions, graphics, logos, artwork, layouts, editorial materials, marketing campaigns, written content, certificates, designs, and other proprietary materials—are protected by applicable intellectual-property laws.

Except as expressly authorized, users may not copy, reproduce, distribute, republish, commercially exploit, modify, scrape, systematically extract, or create derivative works from Authentique Lux proprietary materials.

No license or ownership interest is transferred merely through access to our website or services.

Third-party trademarks remain the property of their respective owners.

20. USER SUBMISSIONS

When you voluntarily provide photographs, descriptions, reviews, testimonials, messages, or other materials to Authentique Lux, you represent that you possess the rights necessary to provide them.

Where reasonably necessary to evaluate, authenticate, market, sell, document, or provide the requested service, you grant Authentique Lux permission to use those materials for those purposes.

This does not transfer ownership of your pre-existing intellectual property to Authentique Lux.

21. PROHIBITED CONDUCT

You may not use Authentique Lux services to:

Commit or facilitate fraud
Purchase using unauthorized payment information
Submit stolen or unlawfully obtained property
Knowingly submit counterfeit merchandise as authentic
Manipulate auctions or bidding
Interfere with website security or operation
Introduce malicious software
Scrape or systematically extract protected content without authorization
Impersonate another person
Violate intellectual-property rights
Harass or threaten Authentique Lux personnel or clients
Engage in conduct prohibited by applicable law

We may refuse or terminate service in response to violations.

22. THIRD-PARTY SERVICES

Our services may integrate with or link to independent providers, including ecommerce platforms, payment processors, auction platforms, authentication providers, insurers, shipping carriers, social networks, and other services.

Those providers operate independently and may maintain separate terms and privacy policies.

Authentique Lux is not responsible for an independent third party’s services, availability, security, policies, acts, or omissions except to the extent liability cannot lawfully be excluded.

23. PRIVACY

Our collection and use of personal information are governed by the Authentique Lux Privacy Policy, which is incorporated into these Terms by reference.

Additional privacy disclosures or consent mechanisms may apply to particular services or jurisdictions.

24. ELECTRONIC COMMUNICATIONS

By conducting business electronically with Authentique Lux, you consent to receive transactional notices and records electronically where permitted by law.

Marketing emails and text messages are subject to applicable consent requirements and opt-out rights.

Opting out of marketing does not prevent us from sending communications reasonably necessary to administer an existing transaction, account, consignment, purchase, auction, or service.

25. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND GENERAL DIGITAL SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

AUTHENTIQUE LUX DISCLAIMS WARRANTIES NOT EXPRESSLY PROVIDED IN THESE TERMS OR AN APPLICABLE TRANSACTION-SPECIFIC AGREEMENT, INCLUDING IMPLIED WARRANTIES TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

NOTHING IN THESE TERMS DISCLAIMS OR LIMITS ANY WARRANTY, RIGHT, OR REMEDY THAT CANNOT LAWFULLY BE DISCLAIMED.

26. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AUTHENTIQUE LUX AND ITS AFFILIATES, OFFICERS, EMPLOYEES, REPRESENTATIVES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO THE USE OF OUR SERVICES.

ANY LIMITATION OF LIABILITY APPLIES ONLY TO THE EXTENT PERMITTED BY LAW.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

I recommend having counsel determine the appropriate monetary liability cap rather than carrying forward the current arbitrary $2,000 figure. The existing Terms presently use that amount.

27. INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify and hold harmless Authentique Lux LLC and its affiliates, officers, employees, representatives, and agents from third-party claims, liabilities, losses, damages, and reasonable expenses arising from:

Your material violation of these Terms;
Your unlawful use of our services;
Your infringement of another person’s rights; or
Materially false representations you make in connection with a transaction.

This provision does not require indemnification to the extent prohibited by applicable law.

28. DISPUTE RESOLUTION

These Terms and disputes arising from them are governed by applicable federal law and the laws of the State of Texas, without regard to conflict-of-law principles.

The existing Terms currently mandate binding arbitration, waive jury trials and class proceedings, permit qualifying small-claims actions, and designate Bexar County, Texas for matters that cannot be arbitrated.

Before carrying mandatory arbitration into the new Terms, Authentique Lux should have Texas counsel approve the exact arbitration procedure, administrator, consumer fee allocation, opt-out procedure, class-action waiver, and required disclosures.

Until that language is professionally finalized, I would not improvise a stronger arbitration clause merely for the appearance of greater protection.

29. GOVERNING LAW

Except where applicable consumer law requires otherwise, these Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.

For disputes properly heard in court and not subject to an enforceable arbitration agreement, the parties consent to an appropriate state or federal court in Texas, subject to applicable jurisdiction and venue requirements.

30. TERMINATION & REFUSAL OF SERVICE

Authentique Lux may suspend or terminate access to services where reasonably necessary because of:

Fraud or suspected fraud
Chargeback abuse
Nonpayment
Counterfeit or stolen merchandise
Misrepresentation
Auction manipulation
Threatening or abusive conduct
Security concerns
Violation of these Terms
Legal or regulatory requirements

Termination does not eliminate obligations arising from transactions entered into before termination.

31. CHANGES TO THESE TERMS

Authentique Lux may update these Terms periodically to reflect changes to our business, services, technology, or legal obligations.

Updated Terms will become effective when posted or on the effective date identified in the updated Terms, subject to any additional notice required by applicable law.

Material changes will not retroactively alter completed transactions or vested contractual rights except where permitted by law or agreed by the affected parties.

32. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

33. NO WAIVER

Failure by Authentique Lux to enforce a provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

34. ENTIRE AGREEMENT & ORDER OF PRECEDENCE

These Terms, together with the applicable Privacy Policy, Final Sale Policy, Shipping Guidelines, Consignment & Sales Agreement, auction conditions, Reserve Program terms, authentication terms, and other transaction-specific agreements, constitute the applicable agreement between Authentique Lux and the client.

If a transaction-specific written agreement conflicts with these general Terms, the transaction-specific agreement controls with respect to that transaction, unless otherwise expressly stated.

35. PAYMENT POLICY & TERMS

To protect our clients, prevent fraud, and comply with our internal security procedures, Authentique Lux reserves the right, at its sole discretion, to require payment by bank wire for purchases of $1,500 or more, or for any transaction requiring additional verification. We may also request identity verification before processing or shipping an order. If a bank wire is required, our Private Concierge will provide secure payment instructions. Orders may be delayed or cancelled if requested verification or payment requirements are not completed.
